Terms of Service
By installing or using BotPilot, you agree to these terms. Read them. They aren't long.
1. Who you're agreeing with
These Terms are between you and 1 MEDIA Studio LLC. ("BotPilot", "we", "us"), a Florida limited liability company. Contact: email@jonathanprivat.com.
2. What you can use
- BotPilot for Android — an on-device engagement assistant for Instagram.
- BotPilot Creator for iOS — a creator inbox, comment manager, and scheduler that connects to your Instagram Professional account through Meta's official Instagram API.
- botpilot.org — this website.
3. Account and eligibility
You must be at least 13 years old (or the minimum age in your jurisdiction). You're responsible for your own Instagram account and for keeping your BotPilot account credentials secure if you have one. You're responsible for everything that happens under your account.
4. Your responsibilities
- Use BotPilot in compliance with Instagram's terms and Meta's Platform Terms. We won't help you violate them.
- Don't use BotPilot to spam, scrape, harass, defraud, or impersonate.
- Don't use BotPilot to send messages to people who haven't opted in or contacted your account first. Meta's 24-hour conversation window is a hard line; we enforce it inside the iOS app.
- Don't reverse-engineer, decompile, or attempt to extract source code from our software, except where permitted by applicable law.
- Don't run BotPilot against an Instagram account you don't own or have explicit written permission to manage.
5. Third-party services
BotPilot interoperates with Meta Platforms, Inc. (Instagram, Facebook Login, Meta APIs). Your use of those services is governed by their own terms and policies. If Meta restricts or terminates your account, we cannot override that.
BotPilot for Android uses Android's Accessibility Service to drive the real Instagram app's UI. The use of Accessibility is permitted by Android for assistive automation, but Instagram's terms restrict automated engagement. You're responsible for any consequences to your Instagram account that result from running the Android app.
6. Subscriptions and billing (iOS)
BotPilot Creator may be offered as a paid subscription via in-app purchase (Apple) or web-billing (Stripe). Subscriptions auto-renew at the price posted on the day you subscribed. You can cancel anytime in your App Store account settings or via the subscription management page if you bought through web-billing. Refunds follow Apple's or Stripe's policy, as applicable.
7. Acceptable use
You may not use BotPilot to:
- Send unsolicited bulk messages, spam, or commercial messages outside Meta's allowed messaging windows.
- Operate "growth" or "follower farm" schemes that violate Instagram's terms or Meta's Platform Terms.
- Harvest data about Instagram users beyond what Meta authorizes for your use case.
- Run unauthorized automation on Instagram accounts you do not own.
- Build a competing service from our software, branding, or content.
Violations may result in immediate suspension of your access and, in serious cases, reporting to Meta or law enforcement.
8. Our license to you
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use BotPilot on devices you own or control, solely for personal or internal business use. We retain all intellectual property in BotPilot itself.
9. Disclaimers
BotPilot is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that BotPilot will be uninterrupted, error-free, secure, or that any defects will be corrected.
We are not affiliated with Meta Platforms, Inc., Instagram, or Facebook. All trademarks are property of their respective owners.
10. Limitation of liability
To the maximum extent permitted by law, BotPilot and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, use, or goodwill, arising from or related to your use of BotPilot.
Our aggregate liability for any claim arising from or related to these Terms will not exceed the greater of (a) US $100 or (b) the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless BotPilot from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of BotPilot in violation of these Terms or applicable law.
12. Termination
You can stop using BotPilot anytime. We can suspend or terminate your access if you violate these Terms, if required by law, or if continued operation isn't feasible (e.g., Meta revokes platform access). On termination we will delete your data per our Privacy Policy.
13. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state and federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction there. Nothing in this section limits your right to bring a small claims action in your local jurisdiction where permitted.
14. Changes
We may update these Terms when our products or laws change. The "Last updated" date reflects the most recent revision. For material changes we will notify you in the app or by email at least 7 days before the change takes effect. Continued use after the effective date constitutes acceptance.
